CODE OF CONDUCT

To ensure everyone has a positive and enriching experience, we ask all participants to follow these guidelines:

Respect and Inclusivity

Treat all class members and instructors—with kindness, respect, and consideration.

Embrace our diverse community and celebrate different perspectives and abilities.

Discrimination of any kind, including but not limited to race, ethnicity, gender, age, ability, or background, will not be tolerated.

Participation Requirements

Parents or guardians must actively participate alongside their children throughout the class.

Supervision of children is the responsibility of the accompanying adult at all times.

Creating a Safe Space

Use encouraging language and support fellow participants in their creative journey.

Be mindful of shared materials and workspace.

Address any concerns with the instructor promptly and respectfully.

We reserve the right to dismiss any participant who violates this code of conduct.

RELEASE OF LIABILITY AND ASSUMPTION OF RISK WAIVER

Event: Tandi Venter Fine Art Playnting Workshops & Events

Location: 6818 Embarcadero Lane, Carlsbad, CA 92011

NOTICE: BY OBTAINING A TICKET, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. This waiver does not apply to liability for gross negligence, willful or wanton misconduct, or intentional harm.

1. ACKNOWLEDGMENT OF RISKS

I acknowledge that participation in art classes and workshops involves certain inherent risks, including but not limited to:

   • Use of art materials, tools, and equipment

   • Potential for cuts, scrapes, or minor injuries

   • Allergic reactions to art supplies or materials

   • Slips, trips, or falls within the studio space

   • Risk of property damage or personal injury

I voluntarily assume all risks associated with participation in this event, whether known or unknown.

2. RELEASE OF LIABILITY

In consideration for being permitted to participate in the event, I, for myself and on behalf of my heirs, executors, administrators, and assigns, hereby RELEASE, WAIVE, DISCHARGE, and COVENANT NOT TO SUE Tandi Venter Fine Art, its owners, employees, instructors, volunteers, and agents (collectively "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property while participating in such activity, to the fullest extent permitted by law.

NOTICE: Under California Civil Code Section 1542, I expressly waive any rights I may have under that section, which states: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

I understand that this means I am waiving my right to make a claim for injuries or damages that I do not know about at this time.

3. INDEMNIFICATION

I agree to INDEMNIFY and HOLD HARMLESS the Released Parties from any loss, liability, damage, or costs, including court costs and attorney's fees, that they may incur due to my participation in said event, whether caused by negligence of the Released Parties or otherwise.

4. MEDICAL TREATMENT

I authorize the Released Parties to obtain or provide emergency medical treatment if necessary. I agree to be financially responsible for any costs incurred as a result of such treatment.

5. PHOTO/VIDEO RELEASE

I grant permission to Tandi Venter Fine Art and its representatives to photograph and/or video record me (or my child, if applicable) during the event. I authorize Tandi Venter Fine Art to use, reproduce, publish, and distribute these images and recordings in print and/or electronic form for promotional and marketing purposes, including but not limited to:

   • Social media platforms (Instagram, Facebook, TikTok, etc.)

   • Studio website and blog

   • Marketing materials and advertisements

   • Newsletters and email campaigns

   • Print materials and brochures

I understand that I will not receive compensation for the use of these images or recordings and that all such materials become the property of Tandi Venter Fine Art.

If you do NOT wish to grant this permission, please inform Tandi Venter Fine Art via email.

6. MINORS

If the participant is under 18 years of age:

I am the parent or legal guardian of the participant. I have read this waiver and understand its contents. I give my permission for my child to participate and agree to be bound by its terms. I understand that I am signing this waiver on behalf of the minor participant and that the minor participant is also bound by these terms.

7. GENERAL PROVISIONS

   • I acknowledge that I have carefully read this waiver and fully understand its contents.

   • I am aware that this is a release of liability and a contract between myself and the Released Parties.

   • I understand this waiver is binding on my heirs, executors, administrators, and assigns.

   • This agreement shall be governed by the laws of the State of California.

   • I acknowledge that I have had sufficient time and opportunity to read this document, ask questions, and seek legal counsel if desired.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND BY OBTAINING A TICKET I AGREE TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
